Mitchell joined the case on behalf of Trump around the time arguments were underway at the Colorado Supreme Court. Georgetown’s Supreme Court Institute, for instance, relies heavily on attorneys who have served in the US solicitor general’s office, the government’s top lawyers before the Supreme Court. (The Institute, which operates on a non-partisan basis and offers its sessions for free, declined to comment on the Trump case arrangement.) Particularly valuable for any moot court, along with former members of the solicitor general’s office, are former Supreme Court law clerks. In that November 2021 controversy, the Supreme Court allowed Mitchell 10 minutes as an an intervenor on the Texas side.

April 4 (Reuters) - Federal appeals court judges on Tuesday appeared skeptical of 3M's (MMM.N) bid to use the bankruptcy of its subsidiary Aearo Technologies to shield itself from nearly 260,000 lawsuits over allegedly defective military-issue earplugs. Circuit Court of Appeals in Chicago to reverse a bankruptcy court order allowing the lawsuits to move forward against 3M, even though Aearo is bankrupt. Aearo and 3M said the bankruptcy process would facilitate a fair and comprehensive settlement with the plaintiffs. David Frederick, representing the plaintiffs, told the panel that 3M "contrived this bankruptcy to help itself, not Aearo or its creditors." The next-largest MDL, the Johnson & Johnson talc litigation, has 38,000 cases.

But J&J countered bankruptcy court allows all current and future talc lawsuits to be settled together, which it says is the fastest and fairest way. The cancer victims are asking the appeals court to overrule a New Jersey bankruptcy judge who allowed LTL's bankruptcy to continue. LTL's bankruptcy filing automatically stopped lawsuits from proceeding against it, and U.S. Bankruptcy Judge Michael Kaplan in Trenton, New Jersey ruled in February that LTL's bankruptcy should also stop talc lawsuits from proceeding against parent company J&J. In refusing to dismiss the case, Kaplan said the bankruptcy court is better equipped to handle mass tort litigation than other courts.
